Terms of data use. Your photos, interview recording, other personal data, copyrighted and/or performer’s work (should there be any created by you in the materials produced during the Course) may be used by the Controller, including for reproduction, publication, editing, adaptation, translation, in any form and for the purposes specified in this notice. These actions may be performed by the Controller or by its invoked third party (e.g., video editor, public relations agency). Your personal data may be processed, including provided to third parties, in digital form or on tangible media, by any means while ensuring secure and lawful processing. If your ethnicity, religion or health information (e.g., race, headgear, glasses, religious jewellery symbols) is visible in the interview recording or photos or other personal data you will provide, this consent includes your authorisation to use these sensitive categories of personal data as set out herein.
Duration. For Course delivery purpose your personal data will be processed for 10 years after the end of the calendar year the Course has taken place or as long as necessary for the activities of the Controller (e.g., if longer retention period is required by the EU entities financing the Course), whichever is later.
Your consent (if given by ticking respective boxes below) for publication of your data, image, interview, testimonial, will be given for 10 years after the end of the calendar year the Course has taken place or until you withdraw the consent.
If you do not object in this notice (you tick the last box below), generic photos from Course sessions which may have you will remain published until you object as specified below.
If the Controller does not have a legal basis for the further processing of your personal data after you have withdrawn your consent, the Controller will immediately and securely destroy your personal data. If you withdraw your consent, the consent document will be kept for 1 year after the withdrawal and then securely destroyed.
Data sources and recipients. We receive your personal data directly from you or from third parties engaged by the Controller (e.g. photographer, operator, editor). To the extent mentioned above, Controller may publish your personal data on the Course website, social media and/or circulate internally within the Course participants. We may transfer personal data to a third-party providing services to us to the minimum extent necessary (service providers may be controllers or processors of your personal data, depending on the service they provide to us, e.g. event organizers, operators, photographers). Should the Course attract media attention, your data, photos or video records may be published in the media (however, only after your separate approval). Personal data (interview or other video recordings taken during the Course) may be transferred outside the EU to hosting service provider located in the USA. Adequate measures are taken to secure your personal data is safe outside the EU.
Your rights. You have the right to know about the processing of your personal data, to access your personal data and to receive a copy of your personal data, to request the deletion or rectification of your personal data, the right to portability of personal data, to restrict the processing of your personal data, to file a complaint to Lithuanian State Data Protection Inspectorate or to claim damages in court for illegal processing of personal data, and the right to withdraw consent at any time.
Upon receipt of the withdrawal of consent, we will immediately stop processing your personal data subject to consent, but this will not affect the processing of your personal data already performed before the withdrawal of consent and its consequences (e.g., it will not be possible to eliminate consequences of prior publication of your image online).
For more information, for exercise of your data subject's rights, for withdrawal of your consent (re publication of image, testimonial, interview) or for removal of generic photo from Course session with you in the background please notify [email protected]. In cases when you submit a request from an email which does not clearly identify you, we may ask for a scanned copy of your identity document or to otherwise verify your identity before we implement your request.
- Deliver Art Department Masterclasses (Course) services (to perform contractual obligations) to you. For this purpose, the Controller will process your personal data which you have provided in the Course application form (http://www.artdepartmentmasterclass.com/application-form.html);
- For Course publicity purpose, based on your consent, the Controller will publish your name, surname, the fact that you have participated in the Course, your image (photo you have provided to the Controller while filling in application form), your testimonial (selected quotation from your Course application/evaluation form) as well as recorded interview with you;
- For Course publicity purpose, based on Controller’s legitimate interest to raise awareness about the Course, the Controller will publish generic photos from Course sessions which may have you in the background.
By signing this privacy notice you confirm:
- being aware that your personal data will be processed as specified in this notice and consent form;
- being aware that your name, surname, the fact that you have participated in the Course, image, testimonial, interview record will be published only if you consent below (tick respective box);
- being aware that generic photos from Course sessions which may have you in the background will be published on condition that you do not opt out of it (tick respective box below and do not opt out anytime later by notifying [email protected];
- that you transfer your intellectual property rights to copyrighted works (should there be any copyrighted works created in the materials you produce during the Course) as well as to the recorded interview (performer’s rights) to the Controller for the entire term of these rights, worldwide, free of charge, to the maximum extent permitted by law; you will not use the non-proprietary authors and / or performer’s moral rights in such a way as to prevent the Controller from exercising the copyright or performer’s rights transferred to it. Should there be a need, the Controller, in consultation with you, may, in its sole discretion, decide how to identify you as the author and / or performer of any intellectual property created by you or with third parties.
